Welcome to www.apcapital.ca (the “Site”), owned and operated by AP Capital (“AP”). All materials appearing on the Site are either owned by AP or by third parties and are posted on the Site by virtue of a license, grant or some other form of agreement between such third party and AP.

The Site has been created for your personal information. However, in order to access the Site or use the materials contained on the Site you must agree to abide by these Terms and Conditions and all applicable laws. Your use of the Site means that we will assume you have consented to the terms and conditions listed herein, as amended from time to time, and each time you use the Site you indicate your acknowledgement and acceptance of the Terms and Conditions. (i) acknowledge that the unauthorized use of the Content may cause irreparable harm to AP and that in the event of an unauthorized use, AP shall be entitled to an injunction, in addition to any other remedies available at law or in equity, to prevent such irreparable harm and that the balance of convenience in preventing such use rests with AP.

12. Disclaimer of Warranties and Conditions

The Site is provided by AP in good faith but AP does not make any representations or warranties of any kind, express or implied, in relation to all or any part of the Site or the Content or any websites to which the Site is linked, and all warranties and representations are hereby excluded to the extent permitted by law. Further, nothing on the Site constitutes advice, nor should the Site, or any part thereof, be relied upon in making, or refraining from making, any decision. Furthermore, neither the Site or the Content contained therein are necessarily reflective of the views or policies of AP.

You expressly understand and agree that:

The Site allows a user to voluntarily submit an e-mail to AP employees or representatives in circumstances such as where the user may wish to obtain further information about AP, the Site content or services. In those circumstances, AP will route the user e-mail to the appropriate party and will answer the question, but no user log or record is kept nor maintained by AP, once the question or inquiry has been answered.

Please note that the Internet is not a fully secure medium and that any e-mail messages sent may be lost, intercepted or altered, consequently we recommend that you do not include personal information in your e-mail communication with us. These Terms and Conditions will be governed and interpreted in accordance with the laws of the Province of British Columbia. Any dispute under these Terms and Conditions will be brought in the provincial courts of British Columbia located in Vancouver, British Columbia. If you use the Site from another jurisdiction, you are responsible for compliance with any and all applicable local laws. AP makes no representation that the Site or the Contents are appropriate for users outside the Province of British Columbia.

AP reserves the right to changes these Terms and Conditions without notice at any time. Any changes will be posted to this page and it is your responsibility to ensure that you are aware of any such changes from time to time. Changes will become effective 24 hours after they are first posted and you will be deemed to have accepted any change if you continue to access the Site after that time.

These Terms and Conditions operate to the fullest extent permissible by law. If any provision of these Terms and Conditions is unlawful or unenforceable, that provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.
